अमिताभ ने फेसबुक और आई हेट गांधी ग्रुप के खिलाफ मुकदमा दर्ज कराया

थाना गोमती नगर, लखनऊ में फेसबुक नामक सोशल नेटवोर्किंग साईट पर “आई हेट गाँधी” नाम से चल रहे एक ग्रुप के आपराधिक कृत्य के सम्बन्ध में फेसबुक कंपनी तथा अन्य के विरुद्ध प्रथम सूचना रिपोर्ट मु०अ०सं० 72/2011 अंतर्गत धारा 153, 153 A(1)(a), 153 A(1)(b), 153 A(1)(c), 153-B, 290, 504, 505 (1), 505 (2),506 आईपीसी तथा धारा 66 A इन्फोर्मेशन टेक्नोलोजी एक्ट 2000 दर्ज कराई गयी है. यह मुक़दमा आईपीएस अधिकारी अमिताभ ठाकुर द्वारा पंजीकृत कराया गया है.

एफआईआर में यह कहा गया है कि फेसबुक सोशल नेटवोर्किंग साईट इन्टरनेट के माध्यम से हमारे देश में भी सारे कंप्यूटरों पर प्रदर्शित होता है. इसके सदस्य अलग-अलग ग्रुप (समूह) बनाते हैं, जिनमे “आई हेट गाँधी” भी है. इसमें कई गंदे और भद्दे शब्दों और गालियों का खुलेआम प्रयोग किया गया है. ये अत्यंत गन्दी और अशोभनीय गालियाँ हमारे देश के राष्ट्रपिता महात्मा गाँधी के लिए प्रयुक्त की गयी हैं. इन गालियों के जरिये महात्मा गाँधी की प्रतिष्ठा तो धूमिल की ही गयी है, साथ ही इनके द्वारा समाज में विद्वेष बढ़ाने, लोगों को गलत ढंग से उकसाने, लोगों को विचार-समूहों और अन्य आधारों पर बांटने का प्रयास भी किया गया है.

अमिताभ ठाकुर की तहरीर में इस प्रकरण में मुख्य भूमिका राहुल देवगन निवासी ग्राम-खौली, जिला पटियाला, पंजाब की बताई गयी है, जबकि अन्य लोगों में गौरब बनर्जी, रोहन शिंदे, शिक्षित कुमार, गदाधर घोषाल, जसजीत सिंह, देवेन टंडन, अमित आर्य, विग्नेश एन वी तथा अन्य नामित किये गए हैं. इन व्यक्तियों के अतिरिक्त फेसबुक इंक, मुख्यालय पालो अल्टो, कैलिफोर्निया, यूएसए को इस प्रकार प्रदान किये जा रहे सेवा के माध्यम से, किये जा रहे, इस आपराधिक कृत्य के प्रति जानबूझ कर आँखें मूंदे रखने और इस आपराधिक कृत्य के बारे में जानकारी हो जाने के बाद भी उसके प्रति आवश्यक कदम नहीं उठाने के लिए आपराधिक तौर पर जिम्मेदार बताते हुए मुज्लिम बताया गया है.

यह एफआईआर पंजीकृत कराने के पहले ठाकुर ने इनमें से सभी व्यक्तियों से इस बात का अनुरोध किया था कि इस ग्रुप से आपत्तिजनक सामग्री हटा ली जाए, पर इन लोगों ने ऐसा करने से इनकार कर दिया था अथवा इस पर कोई ध्यान नहीं दिया था. साथ ही फेसबुक ने भी ठाकुर द्वारा किये गए निवेदन पर कोई कार्रवाई नहीं की थी और यह ग्रुप यथावत जारी रहा था. इसके बाद ही ठाकुर ने यह एफआईआर कराने की पहल की.

उपरोक्त के आधार पर धारा 153 (जान बूझ कर जब परिद्वेश से अथवा स्वैरिता से प्रकोपित कोई कार्य, यदि इसके कारण किसी प्रकार का दंगा नहीं हुआ हो), 153 A(1)(a), 153 A(1)(b), 153 A(1)(c)- (विभिन्न समूहों में धर्म, मूलवंश, जाति, जन्म स्थान, समुदाय या कसी भी अन्य कारण से नफरत और शत्रुता पैदा करना), 153-B (राष्ट्र की अखंडता तथा राष्ट्रीय एकता को नुकसान करने हेतु गलत ढंग से प्रभावित करने वाले वक्तव्य देना या कृत्य करना), 290 (लोक न्यूसेंस के लिए दंड जब अन्य कोई स्थिति नहीं दी गयी हो), 504 (जानबूझ कर किया गया अपमान जिससे लोक शांति भंग होना संभावित हो, 505 (1), 505 (2) (लोक रिष्टिकरक वक्तव्य), 506 (आपराधिक अभित्रास) आईपीसी तथा धारा 66 A इन्फोर्मेशन टेक्नोलोजी एक्ट, 2000 के अंतर्गत अपराध पंजीकृत किया गया है. विवेचना थाना गोमती नगर पर की जा रही है.

Amitabh registered case against Facebook and I Hate Gandhi group

A criminal case crime No 72/2011 under section 153, 153 A(1)(a), 153 A(1)(b), 153 A(1)(c), 153-B, 290, 504, 505 (1), 505 (2),506 IPC and section 66 A Information Technology Act 2000 has been registered against Facebook Inc. and others at police station Gomti Nagar, District- Lucknow. The complainant is Amitabh Thakur, an IPS officer of UP Cadre, currently on study leave at IIM Lucknow.

The FIR says that Facebook social networking site is seen and shown all across the country through Internet. On this various groups are formed. One of these is “i hate gandhi”. On this site, open abuses and dirty words are used against Mahatma Gandhi, the Father of our Nation. These dirty words and abuses are of such nature that they are wantonly giving provocation with intent to cause riot when riot is not committed (sec 153 IPC), promoting enmity between different groups on grounds of communities and other grounds etc. and doing acts prejudicial to maintenance of harmony (153A IPC), Imputations, assertions prejudicial to national-integration (sec 153 B IPC), public nuisance (290 IPC), Intentional insult with intent to provoke breach of the peace (sec 504 IPC), criminal intimidation (sec 506 IPC) and using Information Technology for these purposes (sec 66A IT Act). Thus the prayer by Amitabh Thakur says that all these words are such that they have been used to intentionally and deliberately provoke the above mentioned crimes.

Before getting the FIR registered, Thakur had communicated to each one of them individually to get the objectionable parts removed from the group site but it was blatantly and deliberately ignored by these members. Similarly, the Facebook did not take the required action to get the site blocked. Only after this, Thakur has now gone for getting the FIR registered.

The FIR says that the primary role in this case is that of Rahul Devgan , village Khauli, District- Patiala, Punjab while other persons involved include Gaurab Banerjee, Rohan Shiunde, Shikshit Kumar, Gadadhar Ghoshal, Deven Tandan, Vignesh NV etc. At the same time, Facebook Inc, Headquartered at Pao Alto, California, USA has also been made an accused for having provided the requisite platform for dissemination of all these information, particularly when they had been requested by Amitabh Thakur some 20 days ago to get this site removed because of its hateful content. The investigation has been taken up by the Gomtinagar police station.
